Terms and conditions for the use of joinup

1. General provisions

joinup is an online platform of the ETH Entrepreneur Club, Stampfenbachstrasse 52/56, CH-8006 Zurich (“ETH Entrepreneur Club”). The aim of joinup is to enable users (talents and startup company representatives) to connect with each other, to apply for or fill job vacancies, and exchange information. The present terms and conditions („Terms“) govern the contractual relationship between the user of joinup (“User”) and the ETH Entrepreneur Club. By using joinup, the User confirms that he or she has read and understood these Terms and agreed to them.

2. Use of joinup

2.1. Right of use

The User may use joinup under the following conditions:

  • The User is of legal age (18 years or older).
  • The User resides in Switzerland.
  • The User adheres to the present Terms and applicable law.
The User agrees to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). You also agree that your profile information will be truthful. The User may only add a startup company to his or her profile if the User is an authorized representative of that startup company. The startup company must be in an early stage of its operations. ETH Entrepreneur Club reserves the right to remove or disable access for companies (or their representatives) it does not consider to be startup companies at its own discretion.

2.2. Availability

ETH Entrepreneur Club has the right to interrupt, restrict, cease or replace the use of joinup at any time and without prior notification. ETH Entrepreneur Club may block the User’s access to joinup (e.g. in case of potential abuse).

2.3. Intellectual property rights and license

All rights (especially copyrights and trademark rights) related to software, texts, images, videos, names, logos and other data and information, which are available or become available in the course of time through joinup, belong exclusively to ETH Entrepreneur Club or the respective partners unless otherwise specified by the present Terms. The names and logos that appear on joinup may be protected trademarks. For the use of joinup for the designated purposes, ETH Entrepreneur Club grants the User a non-exclusive, non-transferable, revocable license, subject to the User’s compliance with these Terms. The User confirms that he or she does not add contents to joinup that infringe any third-party rights.

3. Risks, exclusion of warranty and liability

3.1. Risks in using joinup

The User acknowledges and accepts that the use of joinup involves risks. In particular, the use of joinup may involve the risk that user names and passwords, devices used or personal data of the User may be abused by unauthorized third parties. Thereby the User may incur a financial loss or a violation of personality rights. Further, there is a risk that joinup cannot be used (e.g. login is not possible). Abuse is enabled or promoted in particular by: – a violation of general duties of care by the User (e.g. by careless use of the password); – the User's settings or defective maintenance of devices or systems employed for the use of joinup, e.g., due to a missing screen lock; – interference by third parties or faults during data transmission over the internet (e.g. hacking, phishing or data loss); – weaker security settings for joinup chosen by the User (e.g. saving of login credentials). By using joinup, the User may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. ETH Entrepreneur Club generally does not review content provided by others (including other Users). The User agrees that ETH Entrepreneur Club is not responsible for others’ (including other Users’) content or information.

3.2. Exclusion of warranty and liability

The use of joinup is permitted on an „as is“ basis. ETH Entrepreneur Club provides no warranty, whether express nor implied. Subject only to gross negligence or intent, ETH Entrepreneur Club excludes all liabilities arising under any legal theory for any damages incurred by the User. ETH Entrepreneur Club is not a party of the legal relationships between Users nor the relationship between Users and startup companies. ETH Entrepreneur Club is not liable for any behavior or the fulfilment of obligations relating to these relationships. ETH Entrepreneur Club is not obliged to interfere against any User behavior (even if it breaches any contract or the law). The User shall indemnify, defend and hold harmless ETH Entrepreneur Club from any damage, loss, costs and expenses suffered as a result of User’s behavior.

4. Data protection

The User acknowledges that personal data in connection with the use of joinup is processed by ETH Entrepreneur Club in accordance with the joinup privacy notice. When using joinup, the User acknowledges that the use of joinup is entirely voluntary. The User does not add personal data (including sensitive personal data) on joinup that he or she would not want to be publicly available. The User also acknowledges that messages to other Users including job applications will be directly sent to the email address of the respective User and that ETH Entrepreneur Club is not responsible for the processing of personal data by the Users. Users receiving personal data by other Users must comply with applicable data protection law.

6. Final provisions

ETH Entrepreneur Club may amend these Terms at any time. Such amendments may include but are not limited to the introduction of a license fee. The user will be informed about such amendments in an appropriate manner. He or she may terminate the use of joinup at any time. By continuing to use joinup after having been informed of amendments to these Terms, the user expressly agrees to such amendments. Subject to mandatory statutory provisions, the use of joinup is exclusively subject to Swiss law with Zurich (Switzerland) as its exclusive place of jurisdiction.
